What Happens After an Arrest?

After an arrest, the defendant will be booked through the jail. This process includes verifying their identity, searching for additional warrants, finger printing, and being charged. Once the defendant has been charged, a pre-determined bail schedule will be used to determine how much bail the defendant will have to post to be released from jail. As soon as their bail has been posted, the release process begins. The amount of time it takes to be released will vary from facility to facility. It can take as little as two hours or as long as twelve hours, depending on the size of the jail, the jail location, and the number of staff on duty.

A bail bond is a written agreement between a bail bonds agent, a co-signer, the court, and a defendant stating that the co-signer agrees to take responsibility for the defendant and ensure they meet the requirements of the court. The contract also states that the defendant will pay a percentage of the bail bond amount and a 10% fee and the bail bonds agency will cover the rest in return for the release of the defendant. The defendant agrees to comply with the requirements of the court by attending all hearings and attending any mandatory classes or meetings.

The 8th Amendment of the United States Constitution states that every citizen is granted the right to post bail and be released pending their court date. In exchange for their early release, they must pay a set fee and a bail amount that is monetarily in direct relation to their crime. The more serious the crime, the higher the bail amount. In some cases, if the crime is extremely heinous, no bail will be set and the defendant will be remanded until their trial date. This will also occur if the defendant is a flight risk. The 8th Amendment allows for bail so that the defendant can return home and remain a productive member of society until the date of their trial.

In California, the state mandated for posting a bail bond is 10% of the total bond amount. This fee is non-refundable. According to state law, this fee is also not negotiable. When it comes to our fees, we offer special rates for senior citizens and active duty military personnel, however, the state mandate fee for the bail bond is still in effect.

There are many different types of bail bonds. An immigration bail bond is needed for individuals who are visiting the United States from foreign lands. A weapons bail bond is used when the defendant has been arrested on a weapons charge. A domestic violence bail bond with a PRO attached, is required if the defendant has a domestic violence charge. A property bail bond is used when a person puts up personal property as collateral to cover the cost of the bail bond.

Bail bonds can be paid for in many ways. A cash bond is paid in cash in full to the jail to obtain the release of the defendant. A surety bond is used when the co-signer chooses to pay a 10% fee up front in addition to the bail bonds agency's fee. When paying a surety bond, the fee can be paid in cash, with a credit/debit card, a cashier's check, money order, or any type of personal property that is owned by the defendant or co-signer free and clear with no title liens.

A property bond is one that is secured through the use of personal property that has a set value and is owned free and clear. Property must be owned free and clear and hold substantial resale value. This includes real estate, vehicles, boats, jewelry, etc.

In order to be granted bail the defendant must agree to meet the requirements of the court. This includes attending any and all scheduled court hearings that pertain to their case. They must also attend any court mandated classes that have been ordered by the court, including drug and alcohol classes. If there is a restraining order attached to the bail bond, the defendant must comply with its stipulations as well.

If the defendant leaves the area or does not appear for court, it means they have “skipped” or “jumped” bail. When this happens, the judge will order a bench warrant for their arrest and allow for a specific amount of time for them to be returned to the jail before the entire bond amount is forfeited. If the person turns himself into the court, the bond may be reinstated if they have a valid reason for missing court. If the defendant remains a fugitive, the bond will be forfeited and the entire bond amount becomes due and owing. It will be up to the bail bonds agency to pay the entire amount to the jail and then collect the amount from the co-signer.

Forfeiture means loss. When the bail bond goes through forfeiture, it means that the court is rescinding the person's right to bond and the entire bail bond amount must be repaid to the court. A forfeiture requires that the entire bail bond be paid in full. Even if the person is eventually returned to jail, the bail bond amount must be paid in full. In most cases, the bail bonds agency will pay the amount of the bond and then go after the co-signer to recoup their losses. As part of the bail bond agreement, the co-signer agrees to be responsible for the entire amount of the bond if the defendant chooses not to honor their obligations.

The amount of time the judge gives the defendant to turn himself in after they have skipped bail will be determined by the severity of their crime and other extenuating factors. The courts will often allow two to four weeks for the bail bonds agency to find and return the defendant to the jail before the forfeiture process begins. Once the bail bond has been forfeited, however, the rest of the bail bond immediately becomes due.

A co-signer does have rights. If for any reason they no longer feel comfortable being responsible for the defendant's bond, they can request that it be revoked. During a bond revocation, the bail bond agency will discuss the options with the co-signer and then pick up the defendant. The defendant will be returned to the jail where they will remain until their court date. The bail bond agency will then return any money that is due to the co-signer. The 10% fee that is mandated by the state will not be returned. Once the bail bond has been revoked, the defendant may be able to find another co-signer who is willing to responsibility.

As a bail bond co-signer in California, you have rights. It is your right to say no when it comes to filling out a bail bond application. If at any time you feel uncomfortable with the situation, you can immediately ask for a bond revocation. Along with your rights as a co-signer, you also have responsibilities. It is your responsibility to make sure the defendant remains in contact with the court and attends all court hearings that have been scheduled for their case. You also have the right to all of the information pertaining to the case so that you can remain fully informed.

Defendants also have rights. They have the right to be able to post a bail bond and obtain early release from jail. Defendants also have the right to know every aspect of their case. They have the right to an attorney. If the defendant is able to find a co-signer to help them get of jail, it will be up to them to fulfill their end of the contract. Defendants must report to their bail bond agent on a daily or weekly basis. They must constantly update their personal contact information and make sure to notify the courts of any address or employment changes. The defendant also has the right to a fair and speedy trial.

The amount of time it takes for bail bond money to be released after a case has closed will depend on the court that tried the case. It can take anywhere from four to six weeks for the process to be completed. It can take even longer if any property was used to secure the bail bond. Once the bail bond has been released, the bail bonds agency will pick up the money and the paperwork and then meet with the co-signer to close out the case.
